Going through a divorce is no fun. I don’t have to tell you that. The good news is that you and your spouse control a large part of the process and certainly how you each handle things.

Divorce matters generally come in one of two flavors: contested or uncontested. We have done a pretty in-depth run down of an uncontested divorce, so this page will lean more heavily in discussing a contested divorce action.

Most divorce matters start out as contested. Note that contested does not necessarily mean combative (though it may) – but it really means you and your spouse have not completely worked out all of the details yourselves. That’s where we come in.

Why should I consider the Atkins Law Firm, P.A.?

Our approach to family law is different. Many divorce lawyers are great lawyers. They can help you achieve an outstanding result in family court. But when it is all said and done and you are left with a divorce decree and you still have many needs. We understand that at the heart of family law is the family. In most cases there will still be ongoing contact between former spouses for many years – even after the divorce is final. On top of that many people are in need of skills that they haven’t used in a long time – balancing the checkbook, budgeting for the household, or just making sure you stay organized.

Of course we zealously represent you during the litigation and seek the absolute best outcome possible for your case. But we also strive to help prepare you for life during and after the divorce. Part of this service is done through education. When you understand the litigation process, the flow of the case, and the applicable law, you will better understand our advice and the potential results and hopefully arrive at a more satisfying resolution to your case.

What can I expect if I retain the Atkins Law Firm, P.A.?

We are a full service firm. That means we are going to walk you through your case from start to finish. We will become the point of contact for your spouse and his/her lawyer. We will prepare you for hearings. We will prepare all documents necessary to represent you. We will work to obtain all of the information you need so that you can make a fully informed decision. We will attempt to negotiate a workable settlement and if that fails we will zealously represent you in court.

As your lawyer, we will wear two hats. The first is advocate and is probably what you are familiar with when it comes to divorce lawyers. It means that during negotiations, mediations, and hearings we strongly represent your interests. Our other duty to you is counselor. This means that we are honest and open with you about your case. It’s our duty to share the good, bad and ugly with you so that you can make the best decisions possible.

Education is a core belief of our firm. We desire to make South Carolina family law understandable and applicable to our clients so they can clearly understand the law’s implication on their case. We do this with by using helpful and intuitive client forms, e-mails, flow-charts, one-on-one time with the staff and your lawyer.
