Hi,

You don't necessarily have to live apart for more than one year before you begin your divorce proceedings, but if everything is uncontested and there are no fault based grounds for divorce your final hearing cannot take place until after you have lived in separate residences continuously for more than one year.

My husband and I want an uncontested divorce. He has moved out this week. Do we need to wait one year before starting our divorce proceeds, or is there something we should do in the meantime? Also, must we live apart for one year?

You say that you charge a flat fee for uncontested divorces. Can you tell me the fee? I assume this will the be way we will want to go. No kids, no alimony, splitting all finances.

My wife and I have a 15 month old daughter. She was removed from our custody by DSS on April 17, 2010. We signed over for my parents to get full custody of her about two weeks ago. I know we are not getting custody of our daughter back and have already been informed by DSS. Since I know there will not be a "custody" decision made for our daughter, do I still file having a child or not? My wife and i have been seperated since May 2010.

Thank you for your help in this matter,

Do you have to be present for your final divorce hearing if everything has already been settled?

Lucretia,
Please contact my office through the Connect with Us page on this site to set up an appointment to discuss your case. The fee will dependon the complexity of the issues involved in your case. Often times, when you believe you have worked everything out, there are things that you just have not thought about that will have some significant impact on you down the road. Thanks for your inquiry and for taking the time to comment on this site!
